AXQ Pty Ltd – Returns, Replacements & Repairs Policy

This policy outlines the conditions under which returns, replacements, or repairs may be considered for goods supplied by AXQ. It is designed to provide clarity, manage expectations, and ensure fair and lawful treatment of all transactions.
1. General Overview
AXQ supplies goods across a range of categories, including but not limited to liquidation assets, surplus inventory, and commercial equipment.
Due to the nature of many items sold, returns and remedies are limited and subject to the terms set out below.
Nothing in this policy excludes or limits rights you may have under Australian Consumer Law (ACL) where applicable.
2. Nature of Goods Sold
Unless expressly stated otherwise:
- Goods may be sold as-is, where-is
- Goods may be used, surplus, discontinued, or ex-liquidation
- Packaging may be non-original or absent
- Manufacturer warranties may not apply or may have expired
Item condition, known defects, and limitations will be disclosed in the product listing where reasonably available.
3. Change of Mind

AXQ does not accept returns, exchanges, or refunds for:
- Change of mind
- Incorrect purchase decisions
- Incompatibility with intended use
- Failure to read or understand the product description
- Buyer remorse
This applies in particular to liquidation, clearance, and asset sale items.
4. Faulty, Defective, or Incorrect Items
Eligible Circumstances
You may be entitled to a remedy if the item:
- Is significantly different from its description
- Is faulty or defective beyond what was disclosed
- Was damaged in transit
- Is not fit for purpose where a specific purpose was communicated and relied upon

5. Assessment Process
All claims are subject to assessment.
You may be required to:
- Provide photographs or video evidence
- Provide proof of purchase
- Return the item for inspection (if requested)
- Cooperate with third-party assessors or suppliers where applicable
AXQ reserves the right to decline claims where:
- Damage occurred after delivery
- The item was misused, modified, or mishandled
- The defect was disclosed prior to purchase
- The claim falls outside the notification period
6. Remedies Available
Where a valid claim is confirmed, AXQ may, at its discretion and in accordance with ACL:

- Where an identical or equivalent item is available

- Where repair is commercially reasonable and feasible

- Issued only where replacement or repair is not available or appropriate
Refunds, if approved, are issued to the original payment method only.
7. Liquidation & Asset Sale Items (Important)
Unless expressly stated otherwise:
- Liquidation, clearance, and asset sale items are final sale
- No returns, replacements, or repairs are offered for:
- Known defects
- Wear and tear
- Incomplete sets
- Obsolescence
- Compatibility issues
These items are priced accordingly to reflect risk, condition, and market value.
8. Return Shipping
- If a return is approved due to AXQ error or confirmed fault, reasonable return shipping costs may be covered
- For all other approved returns, the buyer is responsible for shipping costs
- Items must be returned securely packaged and insured where appropriate
AXQ is not responsible for items lost or damaged during return transit.
9. Non-Returnable Items
The following are not eligible for return under any circumstances:
- Custom or special-order items
- Digital products or services
- Items altered or used after delivery
- Items sold explicitly as final, clearance, or as-is
10. Business-to-Business Transactions
For B2B transactions, remedies may be limited or excluded to the extent permitted by law.
Commercial buyers are expected to conduct due diligence prior to purchase.
11. Australian Consumer Law
This policy operates alongside Australian Consumer Law.
Where ACL applies, consumers are entitled to a repair, replacement, or refund for major failures as defined under the law.
Nothing in this policy is intended to exclude statutory rights that cannot lawfully be excluded.
